From all of us at Ethos – we are very proud of our partner, Monique, who was co-counsel in the landmark case of Canada (Attorney General) v. PHS Community Services Society, 2011 SCC 44. The SCC delivered its ruling this morning which ordered the Minister of Health to grant an exemption to Insite under s. 56 of the Controlled Drugs and Substances Act, thereby allowing Insite to continue providing life saving services to injection drug users in the Downtown Eastside of Vancouver.
The Court said, “The Minister’s failure to grant a s. 56 exemption to Insite engaged the claimants’ s. 7 rights and contravened the principles of fundamental justice.”
