The Chair of the Workers’ Compensation Appeal Tribunal has convened a special hearing to determine whether the WCB’s policy regarding the payment of interest is so patently unreasonable that it is incapable of being supported by the Workers Compensation Act and its regulations. Monique represents one of the two workers who challenge the lawfulness of the policy. The policy prohibits the payment of interest on retroactive wage loss and pension benefits except in cases of “blatant error” by the WCB, or where the Workers Compensation Act specifically requires the payment of interest.
